State of Regulated Crypto Assets 2026

The centre of gravity has moved from 'will there be rules' to 'which entity, which document, which register'. The evidence layer has not moved as fast.

Four years ago the dominant public question was whether digital assets would be brought inside financial regulation. That question is now largely answered in the EU, advancing in the UK, contested but densely lawyering in the US, and operational in Singapore, Dubai, Switzerland, Hong Kong and Japan. The 2026 question is different: given that rules exist, can a professional actually reconstruct the issuer and the instrument from public sources?

What changed

  • MiCA Titles III–V are in operation; Article 109 registers are a live public interface.
  • USD and EUR tokenised cash and tokenised Treasury funds have a document trail that looks like fund and banking documentation, not like ICO blogs.
  • Travel Rule expectations are no longer theoretical for VASPs in FATF-aligned centres.
  • Promotions regimes (notably the UK) have changed what can be said to consumers, including on websites that thought they were 'just media'.

What has not changed enough

Beneficial ownership, upgrade-key control, and cross-border entity maps remain the weakest public fields in the RCA registry sample. Tokenised private credit still often presents as a product with a chain address attached. Stablecoin attestations are not interchangeable with statutory audits, and the legal person attested is not always the legal person a holder might assume.

What this proves

Major jurisdictions now operate identifiable crypto-asset, payments, securities or virtual-asset perimeters, and a subset of issuers publish institution-grade document sets.

What it does not prove

That the market as a whole meets a uniform disclosure standard, or that public evidence equals supervisory comfort.
